Enquiry data is stored securely in our internal correspondence records. If a commission does not proceed, we retain your contact details for a period of 12 months from the date of last correspondence, after which it is deleted. If a commission is confirmed, project-related records are retained for 7 years for professional and legal purposes.

Our contact form is processed via EmailJS, a third-party email delivery service. EmailJS transmits your form submission to our inbox and does not store your data beyond the transmission. Please refer to EmailJS's Privacy Policy for details of their data handling.

5. Your Rights Under the DPDP Act, 2023

As a Data Principal under India's Digital Personal Data Protection Act, 2023, you have the following rights:

By accessing or using this website (www.ateliermayne.com), submitting an enquiry, or engaging Atelier Mayne for any design service, you confirm that you are at least 18 years of age, have the legal capacity to enter into a binding agreement, and agree to be bound by these Terms of Use in their entirety.

2. Nature of This Website

This website is a presentation platform for Atelier Mayne's portfolio and services. It is intended solely for the purpose of facilitating commission enquiries. Nothing on this website constitutes a binding offer of services — all engagements are formalised through a separate written agreement signed by both parties.

Atelier Mayne operates as a sole proprietorship under Indian law. All services are provided subject to a signed Letter of Engagement or Service Agreement, which takes precedence over these Terms in matters of project scope, fees, and deliverables.

3. Our Services

Atelier Mayne offers boutique interior design services including, but not limited to: concept development, space planning, material and finish selection, furniture curation, project management, and site supervision. The specific scope of services for each commission is defined in the signed agreement for that project.

We reserve the right to decline any enquiry or commission at our discretion, without being required to provide a reason.

4. Intellectual Property Rights

All creative work produced by Atelier Mayne — including but not limited to design concepts, mood boards, drawings, specifications, 3D visualisations, material schedules, and written briefs — is the exclusive intellectual property of Atelier Mayne and is protected under the Copyright Act, 1957 (India).

Ownership of design deliverables transfers to the client only upon receipt of full and final payment for the relevant phase of work, as stipulated in the signed agreement. Until such payment is received, all work product remains the property of Atelier Mayne and may not be reproduced, shared, or executed by any third party.

All content on this website — including photography, text, graphics, and logos — is the exclusive property of Atelier Mayne. No content may be reproduced, modified, or distributed without prior written consent.

5. Client Responsibilities

When engaging Atelier Mayne, clients agree to:

• Provide accurate, complete, and timely information required for the project
• Ensure necessary site access, approvals, and permissions from relevant housing societies, local authorities, or landlords where applicable
• Review and provide written approval of design documents within the timelines agreed upon — delays in client approvals may affect project timelines and may attract additional fees
• Not engage other interior designers, contractors, or vendors for the same project scope without prior written consent from Atelier Mayne
• Communicate all change requests in writing — verbal instructions will not be acted upon without written confirmation

6. Fees, Payment & Cancellation

All fees are agreed upon and documented in the signed Letter of Engagement prior to commencement of work. The following general terms apply unless otherwise specified in writing:

• Retainer: A non-refundable retainer is required to commence any project. This retainer confirms the booking and removes the client's slot from availability.
• Payment schedule: Payments are due at milestones agreed in the signed agreement. Work on subsequent phases will not commence until outstanding payments are cleared.
• Late payment: Invoices unpaid beyond 14 days of the due date may attract interest at the rate of 1.5% per month, and work may be suspended until payment is received.
• Cancellation by client: If a client terminates the engagement after work has commenced, all fees for work completed to date are due and payable. The non-refundable retainer is not returned.
• Cancellation by Atelier Mayne: In the unlikely event that Atelier Mayne must withdraw from a project, fees for work completed to date will be invoiced, and the balance of the retainer (if any, beyond work completed) will be refunded.

All prices are in Indian Rupees (INR) unless otherwise stated. Applicable taxes (GST) will be charged as per prevailing Indian tax law.

7. Confidentiality

Atelier Mayne treats all client project information — including budgets, floor plans, family composition, and design preferences — as strictly confidential. This information will not be shared with any third party except vendors and contractors engaged to execute the project.

Atelier Mayne reserves the right to photograph completed projects and include them in its portfolio, website, and social media channels, unless the client expressly requests otherwise in writing prior to project completion.

8. Limitation of Liability

To the fullest extent permitted by applicable Indian law, Atelier Mayne's liability to any client in connection with any project shall not exceed the total fees paid by that client to Atelier Mayne for the specific phase of work in which the issue arose.

Atelier Mayne is not liable for:

• Delays, defects, or failures caused by contractors, vendors, or third-party suppliers
• Structural, electrical, plumbing, or civil engineering matters, which remain the responsibility of the appointed contractor and relevant licensed professionals
• Variations in material colour, texture, or finish from samples, as these are inherent in natural and handcrafted materials
• Loss of use, consequential, or indirect damages of any kind

9. Disclaimer of Warranties

This website and its contents are provided on an "as is" and "as available" basis. Atelier Mayne makes no warranties, express or implied, regarding the accuracy, completeness, or fitness for a particular purpose of any content on this website.

Portfolio images may reflect collaborations, styling choices, or photography conditions that differ from project-to-project outcomes. They are illustrative of our aesthetic sensibility and not guarantees of identical results.

10. Third-Party Links

11. Governing Law & Jurisdiction

These Terms of Use and any dispute arising from your use of this website or engagement of our services shall be governed by and construed in accordance with the laws of India.

Subject to Clause 12 below, the courts of Mumbai, Maharashtra shall have exclusive jurisdiction over any disputes arising under these Terms.

12. Dispute Resolution

In the event of any dispute, claim, or controversy arising out of or relating to these Terms or any engagement with Atelier Mayne, the parties agree to first attempt resolution through good-faith negotiation within 30 days of written notice.

If the dispute is not resolved through negotiation, it shall be referred to and finally resolved by arbitration under the Arbitration and Conciliation Act, 1996 (India), as amended. The arbitration shall be conducted by a sole arbitrator mutually agreed upon by the parties, in the English language, seated in Mumbai, Maharashtra.

Atelier Mayne reserves the right to update or amend these Terms of Use at any time. The date of the most recent revision is displayed at the top of this page. Continued use of this website or our services following any changes constitutes acceptance of the revised terms.
